Terms and Conditions
Definitions
- ‘The Promotion’ means the competition to win $10,000 worth of Bitcoin (‘BTC’) and a signed guernsey from the Western Bulldogs, as governed by the Terms and Conditions established by this document.
- ‘The Promoter’ means Casey Block Services Pty Ltd trading as CoinSpot, Australian Business Number 19 619 574 186.
- A ‘Participant’ is any person who submits an entry into the Promotion, regardless of whether or not that person is eligible to participate.
- The ‘promotional period’ is from 12:00am AEST on 24th of September 2021 to 11:59pm AEDT on 3rd of October 2021.
General
- Information on eligibility, mechanisms on how to enter and prizes form part of these Terms and Conditions.
- These Terms and Conditions represent the entire agreement between the Promoter and any Participant (including the winning Participant) and supersede any prior agreement, understanding or arrangement between the Promoter and any Participant (including the winning Participant), whether oral or in writing.
- By participating in the Promotion, each Participant is deemed to have unconditionally agreed to be bound by these Terms and Conditions.
Eligibility
- Entry to the Promotion is open to all individuals who, at the time of entry, meet the following criteria:
- You are an Australian resident;
- You are over eighteen (18) years of age; and
- You are a natural person (not a corporate or government entity).
- Participants must also, at the time of entry, either:
- Have an existing CoinSpot account and have completed any Know Your Customer (‘KYC’) identity verification requirements; or
- Be willing to create a CoinSpot account at https://www.coinspot.com.au/register and completeany KYC identity verification requirements prior to the end of the promotional period.
- Employees of, immediate family members to, retailers, suppliers, associated companies and agencies related to the Promoter are not eligible to enter in the Promotion.
- All entries of Participants who are under the age of eighteen (18) years, do not have the consent of their legal guardian and who enter the Promotion without disclosing or by attempting to conceal their age will be deemed invalid.
- All entries of Participants who are not eligible will be deemed invalid.
- The Promoter reserves the right to deem invalid the entry of any participant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging the goodwill or reputation of the Promotion and/or Promotor.
- The Promoter reserves the right, at any time, to verify the validity of entries and Participants (including a Participant’s identity, age and place of residence) and to disqualify any Participant that does not meet the eligibility requirements. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Prizes
- There will be one winning Participant of the Promotion.
- The winning Participant will receive the following prizes (collectively ‘the Prize’):
- $10,000 AUD worth of Bitcoin (‘the BTC’); and
- One signedAFL Western Bulldogs guernsey (‘the Guernsey’).
- The BTC will be purchased using CoinSpot’s instant buy/sell function and will be calculated with the conversion rate set at the exact time the BTC is credited to the winning Participant’s CoinSpot account by the Promoter.
- The Guernsey is ‘signed’ in that it is autographed by a player, or players, of the AFL Western Bulldogs 2021 team.
- The Guernsey will be of a size and style determined by a representative from the Western Bulldogs; a particular size and/or style cannot be requested by the winning Participant.
- The Prize will be awarded in the name of the winning Participant.
How to Enter
- To submit an entry into the Promotion, Participants must complete an entry form at www.coinspot.com.au/wbpartnershipand tell us in twenty-five (25) words or less what they would do with $10,000 worth of BTC.
- All entries must be an independent creation by the Participant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions or promotions.
- All entries must be submitted before the end of the promotional period.
- Participants may only submit one (1) entry. Only the first entry submitted by a Participant will be considered, any additional entries will be deemed invalid.
- An entry is deemed as received when CoinSpot receives the submission data from the Participant where at the time and date the entry is logged as having been received by the Promoter.
- Participants are responsible for any and all expenses incurred when entering the Promotion and accessing, claiming and/or using the Prize (unless otherwise is stated in these Terms and Conditions).
The Draw
- The draw to determine the winning Participant (‘the Draw’) will be conducted by the CoinSpot marketing team who will determine which entry is the best based on individual merit.
- The outcome of the Draw is final. No correspondence or complaints regarding the outcome of the Draw will be accepted or responded to by the Promoter.
- The Draw will take place on the 4th of October 2021 by 10:00am AEDT.
- Thewinning Participant will be notified within forty eight (48) hours of the Draw by receiving a telephone call to the phone number registered to their CoinSpot account.
- Should a Participant’s contact details change during the promotional period, it is the Participant’s responsibility to notify the Promoter.
- The name of the winning Participant will be published within 48 hours on our verified social media channels once the winning Participant has been notified. By entering the Promotion, the winning Participant consents to the publication of such information.
- In the event that the winning Participant’s entry is deemed or found to be invalid, the Promoter may redraw or decide on another winning Participant.
Redemption and Delivery of Prizes
- The redemption period commences on the date of the Draw and ends three (3) months from the date thereof.
- The winning Participant is required to redeem the Prize within the redemption period. If the winning Participant does not claim the Prize within the redemption period, the Prize will be deemed to be forfeited by the winning Participant.
- The winning Participant will be taken to have redeemed the Prize upon written and/or verbal confirmation by the winning Participant to the Promoter.
- The Promoter will attempt to deliver the Prize to the winning Participant within fourteen (14) days of redemption by the winning Participant.
- The BTC will be delivered to the winning Participant by a direct credit to the winning Participant’s verified CoinSpot account.
- The Guernsey will be delivered to the winning Participant by way of sending the Guernsey by registered post to the winning Participant’s provided address.
- The winning Participant will be taken to have received the BTC once the BTC has been transferred by the Promoter into the winning Participant’s verified CoinSpot account.
- The winning Participant will be taken to have received the Guernsey once the Guernsey has been sent by the Promoter to the winning Participant’s provided address.
- If the winning Participant fails to redeem the Prize in accordance with clauses 34 to 36, a second draw (‘Unclaimed Prize Draw’) will take place on the first business day after the expiry of the redemption period. The Unclaimed Prize Draw will take place in the same manner as the Draw, subject to any directions from a regulatory authority. The winning Participant of the Unclaimed Prize Draw will be notified within forty eight (48) hours of the Unclaimed Prize Draw in accordance with clause 30.
- If any Prize is unavailable and the Promoter has used all reasonable efforts to arrange the Prize, the Promoter may, in its absolute discretion, reserve the right to substitute the Prize with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
Miscellaneous
- Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify, the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Consumer Act 2010 (Cth) or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’).
- Despite anything to the contrary, to the maximum extent permitted by law, the Promoter will not be liable under these Terms and Conditions for any consequential loss including but not limited to any special, indirect or consequential loss, loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use (including both real and anticipatory) and/ or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
- Except for any liability that cannot by law be excluded by law (including the Non-Excludable Guarantees), the Promoter (including its respective officers, employees and agents) will not be liable to a Participant for, and the Participant indemnifies, waives and releases the Promoter in respect of all liability (including but not limited to all expenses, costs, damages, claims, losses) arising in any way out of or in connection with:
- any act or omission of the Participant;
- any breach of these Terms and Conditions by the Participant;
- any Force Majeure;
- a matter arising out of clause 48 of these Terms and Conditions;
- any personal injury or loss;
- claiming any Prize;
- use of any Prize in any way;
- any theft of any Prize or unauthorised access or third party interference in the Promotion;
- any entry or Prize claim that is late, lost, altered, damaged, delayed or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or
- any tax liability incurred by a winning Participant.
- If performance of the Promotion, provision or use of the Prize (or any part of it), or any obligation under these Terms and Conditions is prevented, restricted, or interfered with by a Force Majeure, and if as a result the Promoter is unable to carry out its obligations or to provide the Participant with the Prize (or any part of it), the Promoter may in its absolute discretion, subject to any written directions made under any applicable legislation, cancel, terminate, modify or suspend the Promotion and/or, if necessary, provide an alternative prize or prizes to the same value as the original Prize. The Promoter will give public notice, by way of publication on our verified social media channels, of such an event and that the Promotion has been cancelled, terminated, modified or suspended. Force Majeure means any event or circumstance beyond the Promoter’s reasonable control includes, without limitation, epidemic, pandemic (including COVID-19, and any mutations or variations to this disease or illness), acts of God, fire, explosion, vandalism, storm or other similar occurrence, orders of acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lock-outs and work stoppages, terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion. The Promoter will use reasonable efforts under the circumstances to avoid or minimise any Force Majeure. An act or omission will be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates.
- The Promoter accepts no responsibility and will not be liable for any late, lost, delayed, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
- To the maximum extent permitted by law, as a condition precedent to accepting the Prize, the winning Participant must sign any legal documentation as and in the form reasonably required by the Promoter and/or Prize suppliers, including but not limited to a legal release and indemnity form.
- In the event that a dispute arises as to the identity of an online Participant, the entry will be deemed to have been submitted by the authorised account holder of the email address. The authorised account holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation that is responsible for assigning email addresses for the domain associated with the email. The Promoter may ask any Participant to provide the Promoter with proof that such party is the authorised account holder of the email address associated with the entry.
- The Promoter collects personal information in order to conduct the Promotion and may use that information in accordance with CoinSpot’s Privacy Policy. Entry is conditional on providing this information. Participants should direct any request to opt out, access, update or correct information to the Promoter. All entries, including the personal information contained in them, become the property of the Promoter.
- Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the CoinSpot platform (‘the Platform’), or the information on the Platform, or to otherwise undermine these Terms and Conditions or the legitimate operations of the Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a Participant, the Participant agrees to indemnify the Promoter for those losses, damages and costs.
- The platform for the Promotion may contain links to other websites (Linked Sites). The Promoter does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the platform are for the Participants’ convenience only and Participants agree to access, use and otherwise deal with Linked Sites at their own risk.
- Social media membership pages, applications and use of social media generally is subject to the prevailing Terms and Conditions of use of the social media platform. Unless otherwise indicated in these Terms and Conditions, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and Pinterest. If a Participant uses social media to participate in the Promotion, the Participant understands that they are providing their information to the Promoter and not to any social media platform. Participants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. By participating in the Promotion, the Participant releases Instagram, Facebook, Twitter, Pinterest or applicable social media sites from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associated with the Promotion.
- A party may not commence court proceedings relating to any dispute arising from the Agreement to these Terms and Conditions (‘Dispute’) without first meeting with the other party to (in good faith) resolve the Dispute. If the parties cannot resolve the Dispute at that meeting, either party may refer the matter to a mediator. The parties agree to attend the mediation in good faith. The costs of the mediation will be shared equally between the parties. Nothing in this clause will operate to prevent a party from seeking urgent injunctive or equitable relief from a court.
- Unless the contrary intention appears, a reference in these Terms and Conditions or in any advertisement relating to the Promotion, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.
- These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority.
- The Promoter excludes all, warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.
